Introduction & Acceptance of Terms
Welcome to TryLyst! These Terms of Use ("Terms") govern your access to and use of TryLyst LLC ("Company", "we", "our", "us"), including our website, services, and communications (collectively, the "Platform"). By accessing or using TryLyst, you agree to comply with these Terms and our Privacy Policy. If you do not agree, you should not use TryLyst.
Eligibility
You must be at least 18 years old to use TryLyst. By accessing or using our Platform, you confirm that you meet this requirement and have the legal capacity to enter into binding agreements.
Description of Services
TryLyst provides services for two primary audiences: For Consumers: - Discover and try new products through prequalification surveys and opt-in campaigns. - Submit honest feedback, reviews, and social content in return for access to product trials, incentives, or reimbursements. - Reimbursements are contingent on each campaign’s requirements (e.g., valid receipt, review submission, social post, etc.) and not guaranteed upon receipt upload alone. - We strive to process valid reimbursements within 72 hours of full task completion. - Selection for campaigns is not guaranteed and is based on brand preferences, availability, and platform criteria. For Brands: - Receive aggregated, anonymized consumer insights, feedback, and content. - Syndicated reviews and UGC across third-party platforms for greater reach and visibility. Participation in sampling programs is subject to availability and campaign-specific qualifications.
User Responsibilities & Acceptable Use
By using TryLyst, you agree to: - Provide truthful and accurate information when signing up or submitting surveys. - Use the Platform for its intended purpose—discovering and reviewing products. - Follow all applicable laws and regulations. You may NOT: - Provide false or misleading information (e.g., creating multiple accounts for additional product samples). - Attempt to manipulate survey results or brand campaigns. - Use the Platform for spam, harassment, or unauthorized commercial activity. - Engage in any activity that disrupts, damages, or compromises TryLyst’s website or services. Violation of these rules may result in account suspension or termination.
Intellectual Property & Content Rights
All content and materials available through the TryLyst Platform—including logos, designs, text, graphics, surveys, software, and other proprietary features—are owned by or licensed to TryLyst LLC and are protected by intellectual property laws. You may not copy, reproduce, distribute, or otherwise use any of these materials without our express written permission. By submitting reviews, ratings, survey responses, testimonials, photos, videos, audio, written feedback, or any other content (“User-Generated Content” or “UGC”)—whether uploaded to TryLyst, posted publicly on social media tagging or mentioning TryLyst, a participating brand, or a campaign hashtag, or otherwise created in connection with a TryLyst campaign—you: - Retain ownership of your original content. - Grant TryLyst LLC and its brand partners, affiliates, retailers, distributors, marketing agencies, and other authorized third parties a perpetual, worldwide, irrevocable, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, adapt, modify, publish, translate, create derivative works from, distribute, transmit, publicly display, publicly perform, and otherwise exploit the Content, in whole or in part, in any form, medium, or technology now known or later developed. - Authorize use for any purpose, including but not limited to marketing, advertising, publicity, social media, paid media, email campaigns, product packaging, research, product development, in-store displays, e-commerce listings, television, radio, and other commercial or promotional purposes. - Permit syndication of your Content to third-party review and syndication platforms (including but not limited to Yotpo, Bazaarvoice, Amazon, Walmart, Sephora, TikTok Shop) where it may appear on brand websites, retailer listings, advertising channels, in-store displays, and other online or offline marketing, promotional, or commercial channels, with attribution such as “Originally posted on TryLyst.” - Acknowledge that once syndicated, your Content is governed by the terms of those third-party platforms and may remain publicly visible indefinitely. - Agree that TryLyst may insert FTC-compliant disclosures (e.g., “#ad,” “#gifted”) or attribution text into your Content before or during publication or syndication. - Waive any right to inspect, approve, or receive compensation for the use of your Content. - Agree that this license survives account termination. You may not submit content that infringes the intellectual property rights of others. We reserve the right to remove any content we believe may violate these Terms.
Product Use & Safety Disclaimer
Products provided through TryLyst campaigns are supplied directly by participating brand partners. TryLyst does not manufacture or test these products. You are solely responsible for reviewing all packaging, ingredient lists, instructions, warnings, and safety information provided by the brand or retailer before use. If you have allergies, sensitivities, medical conditions, or other health concerns, you must consult a qualified professional before using any product received through TryLyst. By participating in a campaign, you agree that TryLyst LLC and its brand partners are not responsible for any adverse reaction, injury, or harm resulting from your use or misuse of any product provided through the Platform.
Data Integrity, Availability & Retention
We retain your data for as long as needed to support campaigns, analyze performance, fulfill legal duties, and improve our services. You can request deletion at any time by emailing info@trylyst.com. While TryLyst uses commercially reasonable measures to store and protect your information, we do not guarantee that your data will always remain available or intact. In the event of a system failure, security breach, platform update, account migration, or other unforeseen event, some or all of your information and content may be lost, deleted, or become inaccessible. You are solely responsible for maintaining copies of any content, information, or records you wish to preserve. TryLyst is not liable for the loss, deletion, or corruption of data, and you may be required to re-register, re-verify your account, or re-submit content or campaign proof in the event of data loss or account migration.
Campaign Participation
By opting into a TryLyst campaign, you agree to: - Follow campaign instructions (e.g., use a prepaid incentive, upload proof of purchase, submit honest feedback). - Participate with genuine intent to try and evaluate the product. - Include FTC-compliant disclosures in any public content shared as part of a compensated or incentivized campaign. If participating in a reimbursement campaign (e.g., TikTok Shop, Walmart, or in-store), you agree to purchase the designated product, follow all campaign instructions, and submit valid proof of purchase, review, and/or content (depending on campaign requirements) to qualify for reimbursement. We strive to reimburse within 72 hours of full task completion. Reimbursements are not guaranteed if requirements are not met.
Public Social Media Content
If you publicly tag, mention, or otherwise engage with TryLyst or brand campaigns on platforms such as Instagram or TikTok, or create content in connection with a TryLyst campaign, you grant TryLyst and its partners permission to: - Repost, reshare, archive, feature, or otherwise use your public content in advertising, marketing, reporting, or other public-facing materials across digital and physical channels. This applies to publicly available content in line with social platform policies.
Disclaimer of Warranties
TryLyst provides its Platform "as is" and "as available," without warranties of any kind. We do not guarantee: - That users will receive products or be selected for campaigns. - The effectiveness or safety of any product sampled. Users assume all risk associated with trying new products.
Limitation of Liability
TryLyst is not responsible for any direct, indirect, incidental, or consequential damages arising from: - Your use or inability to use the Platform. - Issues with products sampled through TryLyst. - Website errors or technical issues. - Reimbursement rejections due to incomplete submissions or rule violations.
Third-Party Links & Content
The Platform may contain links to third-party websites or promotions. We are not responsible for the content, policies, or practices of third-party sites.
Account Termination
We may suspend or terminate your account if: - You violate these Terms. - You engage in fraudulent or disruptive activity. - Your participation negatively affects our community or platform.
Changes to These Terms
We may update these Terms from time to time. We’ll notify you of significant updates via email or the Platform. Your continued use after updates means you accept the new Terms.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved in Delaware courts unless otherwise required by law.
Age Restriction & Children’s Privacy
TryLyst is intended only for users 18+. We do not knowingly collect personal data from minors. If you believe someone under 18 has used our Platform, contact us at info@trylyst.com.
Your California Privacy Rights
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA/CPRA), including: - The right to request what personal information we collect and share. - The right to request deletion of your data. - The right to opt out of data sharing. - The right to know whether your personal data has been shared for campaign, fulfillment, or syndication purposes.
